hardware/plan upgrade after June 3

A friend is looking to get a phone upgrade and I've showed her this site here: http://www.crtc.gc.ca/eng/info_sht/t1302.htm
After going through the whole "When does the Wireless Code apply to you" process I am still a bit confused.
She signed a 3 years contract on May 3 2013
Will her device balance be wiped on June 3rd, or does she still have to pay the balance owing and no other cancellation fees if she wants to upgrade?
I told her I am pretty sure the balance owing will have to be paid but I wanted to check with the local experts here on RFD :)
She is with Telus by the way, not sure if it matters.

Thanks

It should be paid off.

Essentially any personal plan that was signed before June 3 2013 should have their device balance go down to $0.

Because the 3 year plans are suppose to he 2 year plans. And June 3rd is the cut off date.

I signed onto a new 3-yr contract on April 2014 so how does this affect my contract?

Are you sure its a 3 year contract? It should've been 2 years at that time. May be a sketchy corporate plan which is a lot more confusing.

IDK about June 3. GF had issues with her phone and we went to 2 different Wind stores yesterday. Seemed the only option was to get a new phone, but the guy at the Shoppers World was very helpful and made a great suggestion not to upgrade to a new phone yet. Got a $50 replacement for now until the tab is wiped clean and also see if current phone can be fixed. He clarified from the previous lady that June 3 is not the effective date. Not long after though, maybe July?

Thanks you Kamal, you were very helpful. That is the kind of service customers should receive.

They are unsure about the June 3rd date because it is currently under appeal.
This is from the CRTC website:
The Wireless Code applies to all new contracts signed as of December 2, 2013.
It also applies to existing contracts that are renewed or extended, or where the key terms are amended, as of December 2, 2013.
In addition, the code will apply to all wireless contracts as of June 3, 2015, regardless of when they were signed. However, the June 3, 2015 date is currently under appeal.
So we'll see after June 3rd, I wouldn't bother with any provider before that date. They obviously won't tell you to wait until June 3rd to renew your contract.

June 3 2015. Freedom day.

Amazing. June 3 stands and the 24 month amortization of devices is level for everyone now... 24 months after the CRTC protected us with the wireless code. Actually as they intended and we are watching and listening.

A little over the 6 months promised from Fed Court but never too late. Almost no move from the majors other than requesting advance notice of the decision back in Feb... not for marketing but lawyering. ;) Precedent - consumer take note. As for marketing - Wind take note or the flankers surely will.

The public advocates won this round for all of us and will have a charitable donation from me at least as big as the now illegal cancellation fee. Thanks little guy from the little guy.

The CRTC is not perfect, nor is the Wireless Code, but it is certainly a decent work in progress for us as consumers and much of the commish's focus on the average Canadian is a welcome change be it wireless, broadcast television or internet. Lobby groups in backrooms for the big companies need to go the way of "Mad Men" - end of series.

(Advocate hat off). Time to get looking at RFD for best offers as a lot of people will be ready or able to switch providers. Time to put the presure on retention queues like never before... at least not in 2-3 years ;) . Maybe look again to forums if your device is not unlocked yet for June. (Might be a killer time for the unlockers to start a promo or sale - hint hint)

A lot of questions still for each person's 3 year situation but stick to the CRTC site and surveys for the next couple of weeks. Stay informed and let's get RFDing...
