HST Rebate New Housing Question

Hello All,

Wondering if anyone could provide any insight on an issue my father is having.

He purchased a pre-construction home, his job got relocated before taking possession, took possession then decided it was to far from his office so he sold the home (3 months later).

Received a letter from CRA stating because he sold it so quickly, they deemed him essentially as a house flipper and said he had to pay back the HST rebate.

Has this happened to anyone? What would be the best route to take?

Extra:
-provided CRA with documentation on address changes, 407 bills, etc but they state due to insufficient evidence (lack of hydro/water/gas usage, he was staying at my brothers due to it being 5 mins from his office on the weekdays) there wasn't enough to overturn it.

-we've since appealed it and have a court date soon.

As you have a court date soon you should be hiring a Tax Lawyer.

How long did it take to escalate to court? i am assuming $$$ amount is big?
