No refunds Petro Canada mobility ligit?

I have an account with them (under monthly plan) and the way the top offs work is that you basically always will have a some sort of account balance.

As per their policy, "Any remaining balance you have on your Petro-Canada Mobility number will be forfeited." Is that legit in light of CRTC decision 2016-171 ?

I feel like I've been trapped!
