Ontario: Changes to the Highway Traffic Act Effective July 1st 2021

Now that Ontario’s new speeding laws have slipped quietly into effect, when’s the time to start questioning the increased powers of police?

New Stunt Driving Laws

Effective July 1st 2021, the Ministry of Transportation will be implementing several amendments to the Highway Traffic Act with respect to stunt driving and street racing in Ontario. Specifically, drivers charged with stunt driving will now face a 14-day motor vehicle impoundment (currently seven days). Further, drivers found to be speeding in excess of 40 km/h or more on roads with a speed limit of less than 80 km/h can now be charged with stunt driving.

Stunt driving and street racing are dangerous and illegal.

Stunt Driving includes:

Driving 40 kms per hour or more over the speed limit on roads with a speed limit less than 80 kms per hour
Driving 50 kms per hour or more over the speed limit if the speed limit is 80 kms per hour or more
Driving in a way that prevents other vehicles from passing
Intentionally cutting off another vehicle
Intentionally driving too close to another vehicle, pedestrian or fixed object
Driving a motor vehicle in a manner that indicates an intention to lift some or all of its tires from the surface of the highway
Driving a motor vehicle in a manner that indicates an intention to spin it or cause it to circle, without maintaining control over it
Driving a motor vehicle while the driver is not sitting in the driver’s seat
Driving a motor vehicle with a person in the trunk of the motor vehicle
Street Racing includes:

Two or more motor vehicles driving in a way that indicates the drivers are competing
Chasing another motor vehicle
Changing lanes repeatedly at a high rate of speed and weaving through traffic
Drivers who are involved in stunt driving or street racing will be subject to:

An immediate seven-day driver’s licence suspension
An immediate 14-day vehicle impoundment at roadside (whether it is your vehicle or not)
A minimum fine of $2,000 and a maximum fine of $10,000
A jail term of up to six months
A post-conviction licence suspension of up to two years for the first conviction, and up to 10 years for a second conviction within 10 years
Six demerit points
Thank you for driving sober and obeying the speed limit.

These new amendments are pretty general. There is no way these are going to be enforced equally.

It almost seems like the NHL rule in for the "intentional puck over the glass" penalty. There was no way to enforce that so they eventually changed it.

They won't unfortunately, much harder to prosecute a left lane Larry than a kid going 151 on the highway.

Basically you will be charged if you drive too close to a car, a person, or if neither of those are nearby the police officer can just pick any inanimate object within his sight and charge you with being "too close" to that.
Street Racing includes:
Two or more motor vehicles driving in a way that indicates the drivers are competing

These seem up for interpretation. What indicates competition? If there's more than 1 car on the road and the cop is having a bad day you can be charged with street racing and get your car towed without speeding or driving dangerously. If me and another vehicle are going in the same direction the cop can say we're "competing"?

The speed limit and other ones, I might not agree with the concept of being punished before being convicted, but at least its clear what not to do to avoid it (ie don't go 40km/h over the limit ok that's fair), but for these points I think it gives way too much discretion to police officers who already have an abundance of power.

Thats the point.
Conservatives whine about a police state when they are not in power and expand it when in power.
They want to have it both ways.

The problem is, they won't. Just give out speeding tickets like candy and pretend it's a job well done  Just like the stunting tickets, how many are given out for people dashing a left-turn arrow after it has disappeared (this is also stunting) as compared with speeding the ever-decreasing km/h over the limit? Yet I see the former nearly every. Single. Day. And you can too at any light with an advance arrow.

As for when to start questioning the powers of dirtbags like police, that time has come and gone ages ago. There's no questioning as they just continue to grant them more and more powers while society sits back and watches, with the majority fools just talking some bullshit about "bravery"...because it's oh so brave to beat the bejesus out of someone when it's like five armed officers to one guy, and just as brave to run like sissy boys and do nothing when it's any less than that kind of ratio

LOL @ the "too close to fixed object" nonsense too. How close is "too close"--oh guess an officer decides that  Also wonder if people will get charged for driving too close to the ground since they're wheels are touching it and all. Way too close that ground there bucko, suspension for you!

So I guess I can't even floor my gas when sitting at a traffic light when another driver decides to do the same? I just enjoy the feeling and adrenaline. I didn't pay for the horsepower so I can only brag it at the dinner table.
